Terms of Use — FairDrives

Acceptance

By accessing or using FairDrives (the “Service”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Service.

What FairDrives is

FairDrives is a community-powered platform that aggregates out-the-door (OTD) car prices submitted by users. We provide this data as a general reference tool only. FairDrives is:

Not a car dealership or affiliated with any dealership.
Not a financial advisor or lending institution.
Not responsible for any specific transaction you enter into.
Not a guarantee of any particular price.

All prices displayed are community-submitted estimates and benchmarks. They may not reflect current market conditions, regional tax variations, or your specific vehicle configuration.

Eligibility

You must be at least 13 years old to use FairDrives. By using the Service you represent that you meet this requirement. If you are under 18, you must have parental consent.

Your account

You are responsible for maintaining the security of your account.
You must provide accurate information when creating an account.
You may not create accounts for others without their consent.
You may not create multiple accounts to circumvent rate limits or submission rules.
We reserve the right to suspend or terminate accounts that violate these Terms.

Submitting a deal — your obligations

When you submit a deal report, you represent and warrant that:

You personally participated in the transaction you are reporting.
All information you submit is truthful and accurate to the best of your knowledge.
You are not submitting false, misleading, or fabricated data.
You are not a car dealer, manufacturer representative, or agent acting on behalf of a dealership.
You have the right to share the pricing information contained in your submission.
If you upload a purchase agreement, it is genuine and you have removed personal information before uploading it.

You must not submit:

Fake, estimated, or fabricated prices.
Submissions on behalf of a dealership to manipulate benchmark data.
Multiple submissions for the same transaction.
Data from transactions you did not personally participate in.
Submissions designed to inflate or deflate market averages.

We reserve the right to remove any submission that violates these rules without notice.

Content you submit

By submitting a deal report, you grant FairDrives a worldwide, royalty-free licence to use, store, display, and aggregate your submission in anonymised form as part of the Service. You retain ownership of your submission and may delete it at any time.

You may delete a submission from your account. Any associated verification document is also scheduled for deletion.

Prohibited conduct

You must not:

Use the Service to manipulate car prices or deceive other users.
Scrape, crawl, or systematically extract data from FairDrives without written permission.
Reverse engineer, decompile, or attempt to extract source code.
Use the Service for any unlawful purpose.
Impersonate any person or entity.
Submit viruses, malicious code, or harmful content.
Attempt to gain unauthorised access to any part of the Service.
Use automated tools to create accounts or submit data at scale.
Use the Service in any way that competes directly with FairDrives without our consent.

Future premium features

FairDrives is currently free to use. We may introduce optional paid features in the future. If and when we do, we will update these Terms and notify existing users at least 30 days in advance before any charges apply.

Disclaimer of warranties and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy of data.

We do not warrant that:

Pricing data is accurate, complete, or current.
The Service will be uninterrupted or error-free.
Any specific price you find on FairDrives will be available at any dealership.

FairDrives is a reference tool only. Always verify prices directly with the dealership before making any purchasing decision.

To the fullest extent permitted by law, FairDrives and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or losses connected to a vehicle purchase, arising from or relating to your use of (or inability to use) the Service or any pricing data — whether based in contract, tort, negligence, or any other legal theory, and even if we have been advised of the possibility of such damages.

Our total liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months before the event giving rise to the claim, or (b) $100.

Because FairDrives provides community-submitted reference data only, you are solely responsible for your own purchasing decisions. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless FairDrives, its operator, and any successors from any claims, damages, or expenses (including legal fees) arising from:

Your use of the Service.
Your violation of these Terms.
Your submission of false or misleading data.
Your infringement of any third-party rights.

Intellectual property

All content, features, and functionality of FairDrives — including the aggregated pricing data, design, code, and brand — are owned by FairDrives and protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

User-submitted deal data remains your property, licensed to us as described in Section 06.

Third-party links and services

FairDrives may, from time to time, link to third-party websites or services. We are not responsible for the content, policies, or practices of any third party, and links do not constitute endorsement.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe:

Violates these Terms.
Is harmful to other users or the integrity of our data.
Is fraudulent or unlawful.

Upon termination, your right to use the Service ceases immediately. Sections 06, 09, 10, and 11 survive termination.

Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved in the courts located in British Columbia, Canada, and you consent to their jurisdiction.

Before initiating legal action, you agree to contact us at legal@fairdrives.com and attempt to resolve the dispute informally for at least 30 days.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on our website and, if you have an account, by email at least 14 days before the new effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree with a change, you may delete your account before the effective date.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FairDrives regarding your use of the Service and supersede all prior agreements.
